Privacy Policy

This policy sets out how Premier Funding Partners collects, uses, holds and discloses personal information, and the rights available to individuals in respect of that information.

Premier Funding Partners Pty Ltd (ABN 42 320 866 032) provides mortgage broking and finance advisory services. Sanip Shrestha, Director, is a Credit Representative (551116) of Australian Finance Group Ltd (ABN 11 066 385 822), Australian Credit Licence 389087 (AFG).

Premier Funding Partners handles personal information in accordance with the Privacy Act 1988 (Cth), including the Australian Privacy Principles (APPs) and Part IIIA, the Privacy (Credit Reporting) Code, and the National Consumer Credit Protection Act 2009 (Cth) (NCCP Act). AFG’s privacy policy, available at afgonline.com.au, and the privacy policies of the lenders to which applications are submitted, govern the information held by those entities.

Information collected

The personal information collected depends on the services requested and may include identity and contact details and identification documents; employment and financial information, including income, assets, liabilities, expenses, statements, payslips and tax returns; credit-related information, including credit reports obtained with authority; details of the relevant property and transaction; household information required by lenders to assess suitability; and records of dealings with Premier Funding Partners.

Information is collected directly from the individual wherever practicable, and otherwise from lenders, valuers, insurers, AFG, credit reporting bodies (where authorised), co-applicants, guarantors, professional advisers, public registers and referrers. Sensitive information is collected only with consent or as required by law. Tax file numbers are not recorded, used or disclosed, and are masked where practicable on documents provided. Individuals who provide information about another person confirm that the other person has been informed and, where required, consents.

The website at premierfpartners.com.au records standard server-log data (such as IP address, browser type and pages viewed) for security and performance purposes and does not currently use advertising or analytics cookies. Information submitted through the online booking form is transmitted by a third-party email service; the enquiry form generates a draft in the user’s own email application; and the borrowing calculator operates within the browser without transmitting the figures entered.

Purposes

Personal information is collected, held, used and disclosed to:

  • assess the individual’s requirements, objectives and financial situation and determine the suitability of credit products, as required by the NCCP Act;
  • compare credit products, prepare and submit applications, and liaise with lenders, insurers, valuers and advisers through to settlement;
  • verify identity, including for lenders’ anti-money laundering obligations;
  • administer the client relationship and review lending arrangements; and
  • comply with legal and regulatory obligations, maintain records, and manage complaints, disputes and audits.

Information is used or disclosed only for the purpose for which it was collected, a related purpose the individual would reasonably expect, a purpose to which the individual has consented, or as otherwise required or permitted by law. Decisions affecting individuals are not made by wholly automated means.

Disclosure

Where required to provide the services requested, personal information may be disclosed to lenders and credit providers and their agents; AFG, whose systems are used to lodge applications and which supervises compliance; credit reporting bodies (section 4); lenders’ mortgage insurers, valuers and settlement agents; the individual’s solicitor, conveyancer, accountant or other advisers, on instruction; service providers engaged in the operation of the business, including information technology, email and document storage, loan-processing and electronic-signature platforms, each bound by confidentiality obligations; and regulators, courts and external dispute resolution bodies, including ASIC, AFCA and the OAIC, where required or authorised by law.

Premier Funding Partners does not sell personal information. Certain service providers, including those providing website hosting and email delivery, process information on infrastructure located in the United States. Before disclosing personal information overseas, Premier Funding Partners takes reasonable steps to ensure the recipient handles it consistently with the APPs, unless the individual has consented or an exception under the Privacy Act applies.

Credit reporting

With the individual’s express consent, Premier Funding Partners may obtain a credit report from a credit reporting body and use the credit reporting information it contains to assess eligibility and the suitability of credit, and may disclose that information to lenders for the same purpose. Lenders obtain and report credit information independently under their own policies. The credit reporting bodies that may be used are Equifax, illion and Experian, each of which publishes its own credit reporting policy.

Individuals are entitled to obtain a free copy of their credit report from each credit reporting body; to request correction of information that is inaccurate, out of date, incomplete, irrelevant or misleading; to request that a credit reporting body not use their information for pre-screening for direct marketing by credit providers; to request a ban period (initially 21 days, extendable) where they reasonably believe they are or may be a victim of fraud; and to complain to Premier Funding Partners, the credit reporting body, the OAIC or AFCA.

Security and retention

Personal information is held in secure electronic systems and, to a limited extent, in paper records, and is protected by reasonable security measures including encrypted connections, password and multi-factor access controls, and restriction of access to personnel who require it. No method of storage or transmission is entirely secure. An eligible data breach likely to result in serious harm will be notified to affected individuals and the OAIC in accordance with the Notifiable Data Breaches scheme.

Information is retained for as long as necessary to provide the services requested and to satisfy legal obligations. Records of credit assistance are generally retained for a minimum of seven years after the conclusion of the relationship, as required by the NCCP Act. Information no longer required is destroyed or permanently de-identified.

Access, correction and complaints

Individuals may request access to, or correction of, the personal information held about them by contacting Premier Funding Partners (section 7). Requests are responded to within 30 days. No charge applies to making a request or to correcting information; a reasonable fee may apply where providing access involves significant effort, and the individual will be informed in advance. Where access or correction is refused as permitted by law, written reasons will be provided.

Complaints concerning the handling of personal or credit-related information should be directed to Premier Funding Partners in the first instance. Complaints are acknowledged promptly and responded to within 30 days. Where the individual is dissatisfied with the response, or no response is received within that period, the complaint may be referred, without charge, to:
